The Truth about Rape Rape is a very serious crime that falls under the category of Offenses against Persons- sexually related. Rape at common law is defined as the act of having unlawful carnal knowledge by a man of a woman, forcibly and against her will not the spouse of the perpetrator. That definition is broken down into elements that must be proved in order for the case to be classified as rape. Unlawful means not authorized by law. Carnal knowledge also known as sexual intercourse means that the victim must prove that there was some type of penetration. Forcibly means that some type of force must have taken place, either physical force or violence when the victim is trying to prevent being raped. Although force is a very important element in rape it can be proved in many ways. Without consent or against will means that the act must be committed against the will of the women and without her consent.
