Mandatory Minimums
In 1986 Congress passed the Anti-Drug Abuse Act which would sentence convicted drug offenders to a fixed amount of time. A mandatory minimum sentence is a minimum number of years, typically 5- or 10-years in prison that must be served when a person is convicted of a particular crime (Sterling Esq., 2). The Anti-Drug Abuse Act was developed in order to prevent judges from issuing different sentence to people who possessed, distributed, and imported any type of illegal substance. It was also designed to hinder any future criminals from taking part in any sort of illegal drug activity. Importantly, these sentences were determined by the mixture or substance containing a detectable amount of prohibited drugs (Murdoch, 1). For example, possession of ten grams of LSD would automatically engage a 10-year mandatory minimum sentence. LSD is contained in a liquid form in which it is placed on paper, better known as blotter paper. A person caught in possession of LSD would be charged with the weight of the paper and drug together.
