The statistically significant issue in the case of Memorial Hospital v. The Department of Public Aid, was what was the definition of a statistically valid sample as used in the Department’s rules and regulations. This was a case of first impression for Illinois State Appellate court (an issue that had not previously been determined by this court or a higher court that the Appellate court is bound by). Being a case of first impression the court’s interpretation of what constitutes a statistically valid sample could only come from their reasoning based on the expert testimony given in the case. Three expert witnesses were called in the case. They each had different definitions of what constituted a valid sample. The first determined that a simple random sample from the entire population was sufficient to be valid. The second determined that a valid sample is composed of 3 criteria: (1) randomness, (2) efficiency, and (3) representativeness.
