Acquaintance rape, also referred to as date rape is an increasing and relatively common problem in todays society. A 1985, Ms. magazine publication of psychologist Mary Moss research of this topic countered the belief that unwanted intercourse or sexual advances were not rape if they occurred while on a date or if the act was committed by a known assailant.
As of 1990, in California, rape is legally defined as sexual intercourse accomplished against a persons will by means of force, violence, duress, menace or fear of immediate and unlawful bodily injury. A relationship, or history of sexual intimacy does not imply consent (defined as positive cooperation in act or attitude pursuant to an exercise of free will) which is verbally required EVERY time.
