Plant Patents: A Historical Analysis I. Introduction Create, Inspire, and Protect. These three words summarize the purpose of Intellectual Property Law and facilitate its progress. Everyday there are new ideas, some are acted upon and some are forgotten, and it is the goal of intellectual property law to provide a safe haven for those ideas and defend against those who try to unjustly take advantage of them. There are three main subcategories of Intellectual Property law which include: patent, copyright and trademark. In this paper I will be focusing on Patents, and more specifically plant patents. The plant patent industry is greatly unknown, yet filled with a rich history and ingenious ideas. In this paper I will seek to identify what a patent is, sequentially explain its history, and provide current examples of plant patents. Plant patens are an integral aspect of IP law and our modern world, the history of their progress summarizes and concludes their importance and ingenious. II.
