Criminal Trial Process
In Canada, being at trial, whether in Provincial or Supreme Court, the crown presents their case first. They will call witnesses and present evidence to try to prove, beyond a reasonable doubt, that the accused is guilty. The lawyer of the accused will get to cross examine the crown's witnesses, to challenge their credibility or their version of events. After the crown has presented their case, the accused will have an opportunity to present his/her case. After both sides have presented their case, the judge or jury must then decide whether or not the crown has proved beyond a reasonable doubt that the accused is guilty or innocent. However, the criminal trial process system is not foolproof and as a result does not serve justice because the trials can take too long, the jury can be easily influenced, and people are wrongly convicted.
