Utalitarian View of Punishment vs. Kantian View of Punishment Free Essay, Term Paper and Book Report

The Utilitarian argues that punishing a person is justified if and only if doing so has or is likely to have better consequences than not doing so. And by incapacitating the offender, therefore preventing him from engaging in further undesirable behavior, others may be dissuaded from committing the same offense. Although punishment reduces the happiness of the person being punished, Utilitarians believe that punishment often increases the happiness of the society as a whole. The Kantian view of punishment is usually referred to as retributivism. The Kantian view claims that punishment of an individual is justified if and only if it bestows upon the person what he or she deserves. According to Kant and other retributivists, the guilty deserve punishment, and punishment is proportional to guilt. Therefore, people are punished harshly for more serious crimes and punished lightly for lesser crimes.
