The OWBPA, put into effect in 1991, is an amendment to the 1967 Age Discrimination in Employment Act (ADEA). The ADEA prohibits many forms of age discrimination, including biased hiring and firing, denial of benefits due to age, and mandatory retirement for tenured workers. The main issue that the OWBPA deals with is the waiving of ones ADEA right to sue in order to gain better job benefits. Many times has an unsuspecting person signed away his rights for a nice retirement package and let his 40th birthday hit himself in the face as he is pushed out by a new youngster that will probably make that same stupid mistake of waiving his right to sue for age discrimination. The OWBPA requires that employees be presented with complete information about any plan that they sign, and there are strict rules, which can invalidate many waivers. It also requires employers to allow 21 days for employees to consider any waiver. In short, this mandate further prevents age discrimination by adding on to an existing mandate.
