December 13, 1971 a class action law suit was filed on behalf of a pregnant single woman, Norma McCorvey, who challenged the constitutionality of the Texas criminal abortion laws. The Texas law only allowed abortions in circumstances where the mothers life was at jeopardy. This court case would be come to known as Roe v. Wade. McCorveys lawyers argued that the Texas law was said to have been an establishment of religion in violation of the first amendment, that the Texas law was unconstitutionally vague and a violation of the ninth amendment, which states that certain rights not specified in the first eight amendments are reserved to the people. On January 22, 1973 the court made its final decision.
In a 7-2 vote the Supreme Court ruled in favor of Roe, but not on the grounds that McCorveys lawyers had argued.
