Freedom of speech is one of our most valued and controversial Constitutional rights as citizens of this country. In more recent times, freedom of speech has been referred to as protected speech and its context is challenged in different legal cases. One such case where the right of protected speech was challenged occurred in Cape May Point State Park. Toni Egbert, a nudist, violated state law, which prohibits conduct or language which is indecent or unduly annoying to other visitors or state park personnel, for nude sunbathing in June 1987. Egbert received a $100 fine for her actions and lost after challenging the state law, in the Appellate Division of Superior Court. Egbert claims that the law is vague and nude sunbathing is protected under the First Amendment. Was Egberts action protected under the first amendment?
