Discrimination is defined as the preferential or indifferent treatment of, or making a distinction for or against a person based on group or category to which that person belongs, rather than on personal merit (Dictionary.com, 2008). Because of discrimination, many people experience practices on the job to which it becomes necessary to file complaints against employers. This paper will analyze and explain the entire discrimination and civil litigation processes as it applies to private sector employees and employers. Included will be a clarification of how typical complaint proceedings begin with the Equal Employment Opportunity Commission (EEOC) and could continue with civil litigation from the state level up to the United States Supreme Court. In addition, a discussion of other relevant aspects addressing discrimination complaints and disputes in the workplace will be addressed.
