In relation to family members, the law via legislation and court decisions has an important role with varied effectiveness. One area of family law where recent changes to the law have been effective in achieving justice for family members is the area of transsexual and same sex marriages marriages. Under the Marriage Act 1961 marriage is defined as the union of a man and woman to the exclusion of all others, voluntarily entered into for life. This comes from the case of Hyde V Hyde and Woodmansee (1866). People of the same sex are unable to be legally married and cannot be married in another country and have it legally recognized in Australia.
