In this essay I will explore the ethical effects that certain family law customs have in relation to ethical ideas like, justice as fairness, justice as desert and promoting well being in pursuit of the best results. I will argue that the non-application of these principals is not only unethical but negatively effect the parties involved. The application of these principals protects the best interests of child and parents since custody determinations are based on ethically relevant criteria. In particular I will be focusing on the custom in family law where according to James Gross attorney at law "mothers end up with custody in about 90% of all cases involving children." (Gross 53) While the law may be written to be impartial to the father or mother, judges and other final decision makers in these cases are influenced by their human exposure to societal customs and norms. And these influences, bias professional decisions that have ethical effects, which conflict with values like, justice as fairness, justice as desert and the well being of the child and both parents. ......
