Disparate Impact means that an employer tried to implement a policy that is fair and is applied fairly, but ends up discriminating against one or more protected classes of individuals (hr-guide). Any employer can get caught in that situation and not even realize what had happened until the lawsuit comes. Here are some examples of what to look for in a disparate impact case, there may be a written test given, educational requirements, or height and weight requirements. I will give an example of a lawsuit that has the height and weight requirement and how it caused a very qualified person to get denied a job. There are also policies put into place that are intentional discrimination against persons. This is called Disparate Treatment. The literal meaning is a form of discrimination that occurs when two employees are similarly situated and one employee receives inferior treatment or suffers harsher consequences than the other (hrtools).
