Unlawful ‘Enemy Combatants’ Guantánamo Bay Thomas Black Professor H Ameri International Relations 5000 October 12, 2003 Executive Summary An unlawful combatant is a secret agent, saboteur or (at times) a fanatic who pursues an armed purpose outside the normally accepted laws of war. Not being under the authority power of an identifiable body or not wearing the uniform of a sovereign state (as in spying) are the principal reasons for a fighter to be classified as ‘illegal’. Global civilized law governs mutually states’ conduct throughout armed clash and the conditions for detaining enemy combatants. Under the Third 1949 Geneva Convention, combatants who fall into enemy hands are presumptively POWs and are entitled to all fundamental protections for that legal status. The first batch of 20 ‘detainees’ arrived in Guantánamo Bay on January 2002, after a 20-hour flight from Afghanistan.
